Arrested in Atlanta? Here’s What to Do Right Away to Protect Your Rights

ProtectRights

Getting arrested is a frightening and overwhelming experience—especially if it’s your first time encountering the criminal justice system. Whether you’re accused of a misdemeanor or felony in Atlanta or elsewhere in Georgia, what you do in the minutes and hours after your arrest can significantly affect the outcome of your case.

At The Spizman Firm, our Atlanta Criminal Defense Attorneys represent individuals facing serious criminal charges and help them make informed decisions from the very beginning. If you’ve just been arrested in Atlanta, here’s what you need to know—and what you should do immediately.

  1. Remain Silent and Respectful

The most important thing you can do after an arrest is stay calm and say as little as possible. You have a constitutional right to remain silent, and you should use it. Don’t try to explain yourself, argue with officers, or talk your way out of the situation. Anything you say can—and likely will—be used against you in court.

Even if you believe the arrest is a mistake, resist the urge to protest. Stay respectful and wait to speak with your attorney.

  1. Ask for a Lawyer Immediately

You also have the right to an attorney. Clearly state, “I want to speak to a lawyer,” and say nothing more until legal counsel is present. Law enforcement officers are trained to get you talking—but you are not obligated to answer questions without an attorney.

By asserting your right to counsel, you protect yourself from self-incrimination and ensure that someone is advocating for your rights throughout the process.

  1. Do Not Consent to Searches

Unless officers have a valid warrant, you are not required to consent to a search of your home, car, phone, or personal belongings. If asked, politely say, “I do not consent to a search.” Do not resist physically, but make your objection clear. Your attorney can later challenge any illegal searches in court.

  1. Make Note of the Details

If possible, write down or try to remember important details such as:

  • The names or badge numbers of the officers
  • What time and where you were arrested
  • Whether you were read your Miranda rights
  • Anything you said or were told

This information can be helpful for your defense attorney and may come into play during a motion to suppress or trial.

  1. Contact a Criminal Defense Attorney Immediately

Time is critical after an arrest. The sooner you have a knowledgeable criminal defense lawyer involved, the better your chances of protecting your freedom and minimizing damage to your record. Your attorney can help you secure bail, attend your first court hearing, and begin building a strong defense.
