Woman’s Unique Excuse Dismisses DUI

Coming up with excuses to beat a DUI charge is not something unheard of. People consider it all the time. What can I do to get out of this? One woman in New York had one of the most inventive excuses given to date and, the catch is, it was true.

A charge of drunk driving was dismissed against a woman in New York after doctors testified that her body was a brewery. Doctors say that the woman suffers with “auto-brewery syndrome,” a condition that causes the body to metabolize alcohol differently than other people.

After being pulled over in 2014, the woman claimed that she had not had enough alcohol to be considered intoxicated. Police begged to differ after the woman was tested as having a blood alcohol content of 0.33%. At the behest of her lawyer, the woman was tested by two nurses and a physician’s assistant after being closely watched for 24 hours.

Her lawyer testified that at the end of that day, after consuming no alcohol, the woman had a BAC of 0.36%. The woman also submitted evidence from a home breath test kit that showed her BAC every night to be 0.20% without having consumed any alcohol.

Doctors were able to show the court that the woman’s body converts high-carb foods into alcohol. It is a syndrome not unheard of, but not common enough to have been considered a valid excuse among legal circles unless proven to be true.
