Cobb County Personal Injury Lawyer

With over three-quarters of a million residents, Cobb County is the third-most-populous county in the state of Georgia. Around 60,000 people occupy Marietta alone, and a great number brave I-75 traffic every day to commute to and from Atlanta for work. Whether you live in Marietta, Smyrna, Kennesaw, East Cobb, Powder Springs or Mableton, or anywhere in between, statistics show you’ll be in more than one traffic accident during your lifetime. Hopefully, this never happens to you or if it does, no one is hurt. When an injury does occur, though, it can be painful, expensive, and disruptive to your life. An experienced personal injury attorney can represent you in the process of filing a claim against the responsible party and ensure that you are properly compensated with an amount of money that is appropriate to the serious nature of your claim. The Cobb County personal injury lawyers at Hawkins Spizman can offer immediate assistance, day or night.

What if I Get Hurt in an Uber Accident in Cobb County?

Hailing a ride used to require a phone call to a cab company and then a 20-minute wait for the taxi to show up. Now it’s as simple as tapping the Uber or Lyft app on your smartphone, and odds are someone is just around the corner ready to come pick you up. Uber and Lyft drivers for the most part are not professional drivers, although some people have taken to make driving for the app their full-time job. Rideshare drivers, therefore, come in all ranges of driving skill and experience. Some pay better attention than others, some drive safely, some drive when they are too tired, and others drive recklessly or aggressively to turn over fares as quickly as possible.

If you are hit by a negligent Lyft or Uber driver while driving in another car, walking, cycling or riding a scooter, you’ll have a claim against the negligent driver, the rideshare company, or both, depending on the circumstances at the time of the crash. Section 33-1-24 of the Georgia Code sets out the insurance requirements for transportation network companies (TNCs) and their drivers. This law requires either the driver, the TNC, or a combination of the two to carry liability insurance in the following amounts:

  • If the accident happens while the driver is logged into the app but has not yet matched with a rider, $50,000 for bodily injuries or death to one person, $100,000 for bodily injuries or death of all persons injured in the crash, and $50,000 for property damage. Note that these amounts are double the 25/50/25 liability coverage all Georgia drivers must carry. If the driver carried the minimum amount required, then the TNC would pick up the other half to meet the requirements of the law.

  • If the accident happens after the driver has matched with a rider and is either en route to pick up the rider or is already transporting the passenger, the required coverage increases to one million dollars for all injury, death and property damage per accident. A million dollars of uninsured and underinsured motorist (UM/UIM) is required as well. This coverage is likely to be borne entirely by the TNC, as probably no individual driver carries this much liability insurance.

If you are injured as a passenger in an Uber or Lyft, you’ll be covered by this insurance as well. Whether the accident was the fault of your Uber driver or the driver of the other car, chances are that you as a passenger are totally blameless for the accident or your injuries. These cases can get complicated when the insurance companies for the drivers are fighting over who is responsible. We’ll help you sort out where and how to file the appropriate claim or claims, and we’ll stay on top of your case until it is resolved in your favor.

Hawkins Spizman also represents rideshare drivers who are themselves hit by negligent drivers while working for Uber or Lyft. We understand how these drivers expose themselves to greater risk by spending more time on the road trying to earn a living. We can help you pursue a claim against the at-fault driver while also defending you against claims that you were the negligent driver. When drivers get into a car accident with an Uber or Lyft driver and learn about the deep-pocket insurance coverage, they are more likely to try to hold the rideshare driver responsible for the accident.

The TNCs also provide contingent collision and comprehensive coverage to their drivers with either a $1,000 (Uber) or $2,500 (Lyft) deductible. You will also have UM coverage provided by your TNC in case the driver who hits you is uninsured. Call Hawkins Spizman to navigate the complicated issues surrounding your car accident injury claim.
