Georgia separates arson into three different degrees: first, second, and third degree arson. First degree arson involves knowingly damaging or encouraging another person to damage, with fire or explosives, an occupied or unoccupied dwelling, building, or vehicle that belongs to someone else, that is insured against fire, with the intent to defraud a co-owner or spouse, or when it is reasonably foreseeable that it may endanger someone’s life.

Second degree arson involves knowingly damaging or encouraging another person to damage, with fire or explosives, any other property that belongs to someone else for a reason that is not listed under first degree arson.

Third degree arson involves knowingly damaging or encouraging another person to damage, with fire or explosives, any personal property valued at over $25 if it belongs to someone else, is insured against fire, or is done with the intent to defraud the rights of a co-owner or spouse.

Penalties for Arson

Arson is a felony offense in Georgia, with penalties increasing with the seriousness of the arson degree. Third degree arson includes penalties of one to five years in prison and fines up to $10,000. Second degree arson conviction comes with one to ten years in prison and fines up to $25,000. First degree arson includes penalties of one to twenty years in prison and fines up to $50,000. In addition, civil penalties including restitution to the victim may also be ordered in an arson conviction along with a permanent criminal record as a felon, which will show up on any background check for jobs, schooling, and housing.
