What to Do If You’re Pulled Over for DUI in Atlanta

DrunkDriving

Getting pulled over for suspected DUI can be a stressful and intimidating experience. Whether or not you’ve had anything to drink, knowing your rights and how to handle the situation is crucial. At The Spizman Firm in Atlanta, we understand how quickly a DUI stop can escalate, and how the steps you take during the stop can impact your case. Here’s what to do if you’re pulled over for DUI in Atlanta or elsewhere in Georgia.

1. Stay Calm and Pull Over Safely

As soon as you see blue lights behind you, safely pull over to the right side of the road. Use your turn signal, slow down gradually, and stop in a safe location. Turn off your engine, keep your hands visible on the steering wheel, and remain in the vehicle unless asked to exit.

2. Be Respectful but Cautious

It’s important to be polite and cooperative, but you are not required to answer potentially incriminating questions. For example, if the officer asks, “Have you been drinking tonight?” you can respectfully decline to answer. Simply say, “I prefer not to answer any questions without an attorney.” You are required to provide your license, registration, and proof of insurance, but beyond that, you can assert your right to remain silent.

3. Field Sobriety Tests Are Voluntary

Officers may ask you to step out of the vehicle and perform field sobriety tests such as walking in a straight line or following a pen with your eyes. These tests are subjective and can be influenced by nerves, medical conditions, or fatigue. You are not legally required to take these tests, and refusing them does not carry automatic penalties.

4. Understand Implied Consent and Chemical Tests

Georgia has an implied consent law, which means if you are lawfully arrested for DUI, you are required to submit to a chemical test (breath, blood, or urine). Refusing this test can lead to a one-year driver’s license suspension. However, you can still refuse, and sometimes it may be in your best interest depending on the situation. Know that refusing the test does not prevent arrest.

5. Document Everything After the Stop

If you are arrested, try to remember and later write down everything that happened during the stop, including the officer’s behavior, your statements, and any tests administered. These details may become important evidence in your defense.

6. Contact a DUI Attorney Immediately

A DUI charge in Georgia can carry serious penalties, including jail time, fines, license suspension, and a permanent criminal record. The sooner you speak with an experienced DUI attorney, the better your chances of protecting your rights and minimizing the impact on your life. Our knowledgeable Atlanta DUI attorneys can challenge the legality of the stop, the administration of tests, and the validity of any evidence.
